  1. General Provisions


The company Generation Sound Events & Hire PTY Ltd offers non-food catering items for rent, such as furniture, tents, tableware, casino tables and decorations, for events including celebrations, exhibitions, corporate anniversaries, and parties.

Gensound additionally provides services like catering, staff for events and management of all sorts.

The following terms and conditions can be requested in digital or written form via the email address patrick@worldsapart.co.za They are also provided to the customer with every inquiry, rental, and invoice.

  1. Scope and Conditions

    1. These terms and conditions apply to all contracts, deliveries, and other services of Generation Sound Events & Hire PTY Ltd , 5 Heerengracht Street, 8000 Cape Town

 2. These terms and conditions are exclusive. Deviating, conflicting, or supplementary terms and conditions of the lessee will not become part of the contract unless their applicability is expressly agreed to in writing.

 3. The rental items, including all accompanying equipment, remain the property of Generation Sound Events & Hire.

 

  1. Offers and Contract Formation

The lessor’s offers are non-binding and subject to change. All orders and declarations of acceptance must be confirmed in writing or by electronic communication to be legally valid. The same applies to amendments, side agreements, or modifications.

 

  1. Prices

All prices in the offers are net prices and are subject to the applicable VAT, currently 15%.

 

  1. Payment Terms

The total invoice amount must be paid in advance. Unless otherwise agreed, the customer can pay via prepayment or in cash upon delivery.

50% of the total amount must be paid immediately after acceptance. The outstanding amount is due 1 day prior to delivery.

 

  1. Rental Period

The rental agreement starts and ends at the times specified in the respective rental contract. The rental period is calculated in days.

 

  1. Handover and Return

The risk of damage, loss, depreciation, and deterioration of the rental items transfers to the lessee upon handover.

The lessor provides the rental items, including accessories and instructions, at the company’s address for collection no later than the start of the rental period. If delivery is arranged, the risk transfers to the lessee as soon as the items are handed over by the transport personnel.

The lessee must check the rental items for completeness and functionality upon receipt. Subsequent complaints will not be considered. Rental items must be returned in clean and proper condition. If not, a surcharge of 40% of the agreed rental price will apply.

Rental items must be packed and ready for transport at ground level for return or collection. The lessee is responsible for completeness. Costs for any necessary additional collections will be borne by the lessee. Rental items will only be issued upon presentation of a valid ID or passport (copy).

 

  1. Duty of Care/Prohibition on Subletting

    a) The customer must handle the rental items carefully and ensure they are operated only by trained personnel.

    b) The customer may not make alterations to the rental items.


    c) The customer must inform third parties of the ownership rights of Generation Sound Events & Hire If the rental items are seized, confiscated, or stolen, the customer must inform the lessor immediately in writing.

    d) Subletting the provided materials is only permitted with the consent of Generation Sound Events & Hire and must be compensated according to the agreed usage.

 

  1. Liability of the Lessor and Lessee

The lessor assumes the risk of normal wear and tear of the rental items. Delays in delivery or service due to force majeure or other events beyond the lessor’s control do not constitute liability, even for agreed deadlines or terms.

The lessor’s liability for damages is limited to the amount of the invoice or offer. The lessee is liable for loss, damage, discrepancies, or depreciation without claiming non-culpability or force majeure. Missing or damaged rental items will be charged to the lessee. The lessee must comply with all necessary regulations and official requirements, indemnifying the lessor from any claims.

 

  1. Insurance

It is recommended that the lessee insures the rental items against theft at their replacement value for the duration of the event or rental agreement. Otherwise, the lessee assumes full liability. The rental items are not insured by the lessor.

 

  1. Cancellation/Termination

If the client cancels an order, they must reimburse Generation Sound Events & Hire for damages and costs incurred up to that point for planning, organization, etc.

Cancellation fees for ongoing orders are as follows:

  • Up to 8 weeks before delivery: 25% of the rental revenue
  • 8 to 4 weeks before delivery: 50% of the rental revenue
  • 4 to 2 weeks before delivery: 75% of the rental revenue
  • Within 2 weeks of delivery: 100% of the rental revenue

If the client fails to fulfill payment obligations or becomes insolvent, Generation Sound Events & Hire reserves the right to cancel the order. Costs for logistics and personnel are waived in the event of cancellation.

 

  1. Final Provisions
  1. South African law applies. 
  2. If any provision of these terms is invalid, the remaining terms remain effective. The invalid provision will be replaced with a valid one that closely reflects the intent of the parties.
