Definitions of Terms

„Personal Data“ refers to any information that relates to an identified or identifiable natural person (the „data subject“). A person is considered identifiable if they can be identified directly or indirectly, particularly by reference to an identifier such as a name, identification number, location data, online identifier (e.g., cookie), or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural, or social identity of that person.

„Processing“ refers to any operation or set of operations performed on personal data, whether or not by automated means. This term is broad and covers practically any handling of data.

„Pseudonymization“ means processing personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and subject to technical and organizational measures to ensure that the personal data cannot be attributed to an identified or identifiable natural person.

„Profiling“ refers to any form of automated processing of personal data that involves using that data to evaluate certain personal aspects related to a natural person, particularly to analyze or predict aspects related to work performance, economic status, health, personal preferences, interests, reliability, behavior, location, or movements of that person.

„Controller“ refers to the natural or legal person, authority, agency, or other body that determines the purposes and means of processing personal data, either alone or in collaboration with others.

„Processor“ refers to a natural or legal person, authority, agency, or other body that processes personal data on behalf of the controller.

Legal Basis for Processing

In accordance with Article 13 of the GDPR, we inform you about the legal basis of our data processing activities. If the legal basis is not explicitly stated in this Privacy Policy, the following applies: The legal basis for obtaining consent is Article 6(1)(a) and Article 7 of the GDPR. The legal basis for processing to fulfill our services and conduct contractual measures, as well as answering inquiries, is Article 6(1)(b) of the GDPR. The legal basis for processing to fulfill legal obligations is Article 6(1)(c) of the GDPR, and the legal basis for processing to safeguard our legitimate interests is Article 6(1)(f) of the GDPR. If processing is necessary for the protection of vital interests of the data subject or another natural person, Article 6(1)(d) of the GDPR serves as the legal basis.

Security Measures

We take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk, in accordance with Article 32 of the GDPR. These measures include, in particular, ensuring the confidentiality, integrity, and availability of data through the control of physical access to the data, as well as its access, input, transfer, security, availability, and separation. Furthermore, we have established procedures to ensure the exercise of data subject rights, deletion of data, and response to data security threats.

Cooperation with Processors and Third Parties

If we disclose data to other persons or companies (processors or third parties) in the context of processing, transfer data to them, or otherwise grant access to the data, this will only be done on the basis of a legal permission (e.g., if data transfer to third parties, such as payment service providers, is required under Article 6(1)(b) of the GDPR to fulfill a contract), if you have consented, if a legal obligation requires it, or based on our legitimate interests (e.g., when using agents, web hosts, etc.).

Transfers to Third Countries

If we process data in a third country (i.e., outside the European Union (EU) or the European Economic Area (EEA)) or this occurs as part of third-party services or the disclosure or transmission of data to third parties, this will only be done if it is necessary to fulfill our (pre-)contractual obligations, based on your consent, legal obligation, or our legitimate interests. In the absence of statutory or contractual permits, we will process or have data processed in third countries only if special conditions set out in Articles 44 ff. of the GDPR are met, e.g., the processing is based on specific guarantees such as an officially recognized decision of an adequate level of data protection in the third country (e.g., for the USA through the „Privacy Shield“) or adherence to officially recognized special contractual obligations (e.g., „Standard Contractual Clauses“).

Rights of Data Subjects

  • You have the right to request confirmation as to whether data concerning you is being processed, and to obtain access to such data, as well as further information and copies of the data according to Article 15 of the GDPR.
  • You have the right to request the correction of any incorrect or incomplete data concerning you according to Article 16 of the GDPR.
  • You have the right to request the deletion of personal data concerning you, without undue delay, under Article 17 of the GDPR, or, alternatively, to request the restriction of processing under Article 18 of the GDPR.
  • You have the right to request that personal data you have provided to us be transferred to another controller under Article 20 of the GDPR.
  • You also have the right to file a complaint with the competent supervisory authority according to Article 77 of the GDPR.

Cookies and Opt-Out from Direct Marketing

Cookies are small files that are stored on users‘ computers. Various information can be stored within cookies. A cookie primarily serves to store information about a user (or the device on which the cookie is stored) during or after their visit to an online offer. Cookies can be temporary or persistent. Temporary cookies are deleted when the user closes the browser, while persistent cookies remain even after the browser is closed.

If users do not want cookies to be stored on their device, they are asked to disable the relevant option in their browser settings. Stored cookies can be deleted in the browser settings. Disabling cookies may result in limitations to the functionality of this online offering.

Data Deletion

We delete the data processed by us according to Articles 17 and 18 of the GDPR or restrict its processing if necessary. Data that is no longer needed for the purposes for which it was collected is deleted unless there are legal retention obligations.

Google Analytics

We use Google Analytics, a web analytics service provided by Google LLC (“Google”), based on our legitimate interests (i.e., interest in analyzing, optimizing, and operating our online services in accordance with Article 6(1)(f) GDPR). Google Analytics uses cookies. The information generated by these cookies regarding users‘ usage of the online service is typically transferred to a Google server in the USA and stored there.

Google is certified under the EU-US Privacy Shield Agreement, ensuring compliance with European data protection laws (https://www.privacyshield.gov/participant?id=a2zt000000001L5AAI&status=Active).

Google will use this information on our behalf to evaluate the usage of our online service, to compile reports on activities within the online service, and to provide other services related to the use of the online service and internet usage. From the processed data, pseudonymous user profiles may be created.

We only use Google Analytics with IP anonymization activated. This means that the IP address of users will be shortened by Google within EU member states or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there.

The IP address transmitted by the user’s browser will not be merged with other data held by Google. Users can prevent the storage of cookies by adjusting their browser settings. Additionally, users can prevent the collection of data generated by the cookie and related to their usage of the online service by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=en.

For further information on data usage by Google, including settings and opt-out options, please refer to Google’s privacy policy (https://policies.google.com/technologies/ads) and the ad settings for Google advertising (https://adssettings.google.com/authenticated).

User data is deleted or anonymized after 14 months.

Social Media Presences

We maintain online presences within social networks and platforms to communicate with active customers, prospects, and users, and to inform them about our services.

Please note that user data may be processed outside the European Union. This may pose risks for users, as, for example, enforcing user rights might be more difficult. For US providers certified under the Privacy Shield framework, we would like to point out that they are committed to complying with EU data protection standards.

Additionally, user data is generally processed for market research and advertising purposes. For example, usage behavior and inferred interests can be used to create user profiles. These profiles can then be used to display advertisements within and outside the platforms that likely match the users‘ interests. To this end, cookies are typically stored on users’ devices, containing their usage behavior and interests. Furthermore, user profiles may contain data independent of the users’ devices, especially if the users are members of the respective platforms and are logged into them.

The processing of users‘ personal data is based on our legitimate interests in effectively informing and communicating with users according to Article 6(1)(f) GDPR. If users are asked by the respective providers to give consent to data processing (e.g., by ticking a box or confirming a button), the legal basis for processing is Article 6(1)(a) and Article 7 GDPR.

For a detailed description of the processing and opt-out options, we refer to the following provider information.

For inquiries and the exercise of user rights, we recommend that users directly contact the respective providers. Only the providers have access to the users’ data and can take appropriate actions or provide information. However, if you need assistance, feel free to contact us.

Embedding Third-Party Services and Content

We use third-party content and service offerings within our online service based on our legitimate interests (i.e., interest in analyzing, optimizing, and economically operating our online service in accordance with Article 6(1)(f) GDPR). This includes embedding content such as videos or fonts.

This always requires that the third-party providers of such content perceive the user’s IP address because they could not send content to their browser without it. Therefore, the IP address is required for displaying such content. We strive to use only content whose providers use the IP address solely for content delivery. Third-party providers may also use so-called pixel tags (invisible graphics, also known as “web beacons”) for statistical or marketing purposes. These “pixel tags” can evaluate information such as visitor traffic on the pages of this website. Pseudonymous information may also be stored in cookies on users‘ devices, containing technical information about the browser and operating system, referring websites, visit times, and other data related to the use of our online services, and can be linked to information from other sources.
